System of Normative and Legal Regulation of Nuclear and Radiation Safety

Formation and development of the regulatory legal framework in the field of nuclear and radiation safety is one of the leading directions of the current activities of the Gosatomnadzor. When developing legal acts in the field of ensuring nuclear and radiation safety, recommendations of the IAEA are taken into account, as well as regulatory legal acts and other regulatory documents of the Russian Federation and other foreign states with developed nuclear energy.

The national system of normative legal regulation in the field of ensuring nuclear and radiation safety has a hierarchical structure that provides for the compliance of lower legal acts with the requirements of the higher acts.

In the Republic of Belarus, the system of regulatory legal regulation in the field of ensuring nuclear and radiation safety has the form of a pyramid.

The system of the normative and legal regulation includes:pirama_en.JPG

  • international treaties of the Republic of Belarus and other international legal acts containing obligations of the Republic of Belarus;

  • laws of the Republic of Belarus;

  • decrees, enactments and orders of the President of the Republic of Belarus;

  • regulatory legal acts of the Council of Ministers of the Republic of Belarus;

  • regulatory legal acts, including technical regulatory legal acts, in the field of nuclear and radiation safety, the Ministry of Emergency Situations of the Republic of Belarus and other republican government bodies.

The legal basis for the development of nuclear power in the Republic of Belarus consists of:

  • The Constitution of the Republic of Belarus;

  • international treaties of the Republic of Belarus and other international legal acts containing obligations of the Republic of Belarus (the list is given in the section “International Obligations of the Republic of Belarus on Nuclear and Radiation Safety”);

  • The Law of the Republic of Belarus of January 5, 1998 “On the radiation safety of the population”;

  • Law of the Republic of Belarus of July 30, 2008 “On the Use of Atomic Energy”.

The Government of the Republic of Belarus adopted:

  • Resolution of the Council of Ministers of the Republic of Belarus of 24 May 1993, No. 338 “On measures for the physical protection of nuclear materials”;

  • Resolution of December 31, 2008 No. 2056 “On Certain Issues of the Implementation of State Supervision in the Field of Ensuring Nuclear and Radiation Safety”;

  • Resolution of the Council of Ministers of the Republic of Belarus of April 30, 2009 No. 562 “On Approval of the Regulations on the Procedure for the State Registration of Ionizing Radiation Sources and Maintaining the Unified State System for Accounting and Control of Ionizing Radiation Sources”;

  • Resolution of the Council of Ministers of the Republic of Belarus of September 27, 2010 No. 1385 “On Approval of the Regulations on the Physical Protection of Nuclear Facilities”;

  • Resolution of December 7, 2010 No. 1781 “On approval of the Regulation on the procedure for the examination of documents justifying the provision of nuclear and radiation safety in the implementation of activities in the field of the use of atomic energy and sources of ionizing radiation”, etc.

The Ministry of Emergency Situations of the Republic of Belarus adopted resolutions that approved more than 20 standards and regulations for ensuring nuclear and radiation safety, which are mandatory for compliance with technical regulatory legal acts.

In addition, employees of Gosatomnadzor are actively working on the processing and adaptation to national legislation of regulatory legal acts and other regulatory documents of the Russian Federation in the field of nuclear and radiation safety for the construction and commissioning of the Belarusian NPP.
