Main Objectives and Functions of the Gosatomnadzor

CHAPTER 1
GENERAL PROVISIONS
1. The Department of Nuclear and Radiation Safety of the Ministry for Emergency Situations of the Republic of Belarus (Gosatomnadzor) is a structural division of the Ministry of Emergency Situations of the Republic of Belarus (MES) with the rights of a legal entity that performs special functions in the field of nuclear and radiation safety.
2. Gosatomnadzor in its activities is guided by the Constitution of the Republic of Belarus, the Statute on the Ministry of Emergency Situations of the Republic of Belarus, the present Statute and other legislative acts.
3. Gosatomnadzor has an independent balance, bank accounts, a stamp and forms with the image of the State Emblem of the Republic of Belarus, with its name, as well as other stamps and prints.
4. Financing the activities of Gosatomnadzor is carried out at the expense of the republican budget and other sources in accordance with the legislation.
5. The property of Gosatomnadzor is republican property and is assigned to it on the right of operational management.
CHAPTER 2
MAIN TASKS OF GOSATOMNADZOR
6. The main tasks of Gosatomnadzor are:
6.1. state supervision in the field of nuclear and radiation safety;
6.2. control over the implementation of legislation in the field of nuclear and radiation safety.
CHAPTER 3
FUNCTIONS AND RIGHTS OF GOSATOMNADZOR
7. Gosatomnadzor in accordance with the main tasks assigned to it:
7.1. analyzes the practice of applying legislation in the field of atomic energy use, nuclear and radiation safety, and develops proposals for its improvement;
7.2. forms the relevant sections of the approved by the MES list of standards and regulations in the field of the atomic energy use, nuclear and radiation safety;
7.3. participates in the issuance by the Ministry for Emergency Situations of special permits (licenses) to organizations and individual entrepreneurs to carry out activities related to sources of ionizing radiation, nuclear materials, radiation protection equipment and technological equipment for nuclear materials and sources of ionizing radiation, in accordance with the established procedure;
7.4. establishes requirements for the content of documents confirming nuclear and radiation safety of a nuclear installation, a radiation source, a storage facility for nuclear materials, ionizing radiation sources (hereinafter referred to as a storage facility) and activities related to ionizing radiation sources, nuclear materials, radiation protection equipment and process equipment for nuclear materials and ionizing radiation sources;
7.5. organizes a safety review of nuclear facilities, nuclear power facilities, radiation sources and storage facilities, including with assistance of independent experts, as well as a review of their design and engineering documentation;
7.6. within its competence, organizes and implements state supervision over:
compliance with licensing requirements and conditions for the atomic energy and ionizing radiation sources use by licensees;
handling of radioactive waste and spent nuclear materials, their utilization and burying;
ensuring the physical protection of nuclear materials and facilities, radiation sources, storage facilities;
planning protective measures to ensure the safety of workers and the public in case of nuclear and radiation accidents;
compliance with the requirements of regulatory legal acts and technical regulatory legal acts in the field of nuclear and radiation safety in the design (construction), manufacture, storage, installation, operation and decommissioning of equipment and systems of nuclear facilities, nuclear power facilities, radiation sources and storage facilities;
7.7. organizes scientific research on justification the principles and criteria of nuclear and radiation safety, increase the effectiveness of state supervision in the field of nuclear and radiation safety in the atomic energy use, attracts scientific organizations, scientists and specialists, including foreign ones, to conduct relevant scientific research;
7.8. considers and makes, in accordance with the established procedure, proposals for drafts programs (plans) for conducting research and development works aimed at justifying and improving the safety of designed, constructed, reconstructed and existing nuclear facilities, nuclear power facilities, radiation sources and storage facilities;
7.9. organizes the attestation and verification of computer programs, the creation and maintenance of data banks for analyzing safety of nuclear installations, radiation sources and storage facilities, ensures the functioning of the State Accounting and Control System for Nuclear Materials of the Republic of Belarus, the Unified State Accounting and Control System for Ionizing Radiation Sources, and the physical protection system nuclear materials and facilities, nuclear power facilities, radiation sources, storage facilities;
7.10. determines the requirements for the content and procedure for submitting to the Gosatomnadzor information about irregularities in the operation of radiation facilities, nuclear facilities, nuclear power facilities;
7.11. determines the order of investigation of the circumstances and causes of violations in the work of radiation facilities, nuclear facilities, nuclear power facilities, and conducts such an investigation;
7.12. organizes the development of requirements and conditions that exclude the possibility of committing terrorist acts at radiation facilities, nuclear facilities, nuclear power facilities and storage facilities;
7.13. participates in the organization and conduct of work on the certification of equipment, products and technologies for nuclear facilities, nuclear power facilities, radiation sources and storage facilities;
7.14. organizes publication of regulatory legal acts, technical regulatory legal acts, information and reference and other documents necessary for the implementation and improvement of activities in the field of ensuring nuclear and radiation safety;
7.15. organizes professional training, retraining, advanced training and internship of Gosatomnadzor employees;
7.16. develops and sends to the republican government bodies, local executive and administrative bodies and other organizations mandatory proposals for consideration on improving the sustainability of radiation facilities, nuclear facilities, nuclear power facilities;
7.17. takes part in work of:
commissions for preliminary, periodic and acceptance testing of equipment and technical devices used at radiation facilities, nuclear facilities, nuclear power facilities;
special commissions on the selection of radioactive waste disposal sites;
7.18. monitors:
compliance with the requirements of the rules and regulations in the field of atomic energy use;
fulfillment of international obligations of the Republic of Belarus to ensure nuclear and radiation safety in the use of atomic energy and sources of ionizing radiation;
the organization and conduct of vocational training, retraining and advanced training, training of personnel at radiation and nuclear facilities for the safe conduct of work at radiation facilities, nuclear facilities, nuclear facilities;
implementation of measures to improve the emergency stability and safety of radiation facilities, nuclear facilities, nuclear power facilities;
7.19. informs the public in accordance with the legislation on the safety status of radiation facilities, nuclear facilities, nuclear power facilities;
7.20. develops and represents to the MES:
the procedure for testing knowledge of legislation in the field of the atomic energy and ionizing radiation sources use, nuclear and radiation safety among managers and specialists of organizations and individual entrepreneurs operating sources of ionizing radiation, nuclear installations, nuclear facilities, as well as performing work and providing services in the field of atomic use energy, issuance of special permits (licenses) to carry out activities related to the manufacture, use nuclear materials processing and storage of nuclear materials, design (construction), production, storage, installation of ionizing radiation sources, radiation protection facilities and process equipment for nuclear materials and ionizing radiation sources;
proposals for coordination the activities of republican government bodies, local executive and administrative bodies, and other organizations to ensure nuclear and radiation safety;
proposals on ensuring nuclear and radiation safety for use in preparing an annual report to the Council of Ministers of the Republic of Belarus on the state of affairs in the field of protection of the population and territories from natural and man-made emergencies;
7.21. provides, within its competence, the protection of information constituting state secrets;
7.22. checks the work of the republican bodies of state administration, other state organizations subordinate to the Government of the Republic of Belarus on matters of ensuring radiation safety, the performance by authorized officials of the duties assigned to them in this area;
7.23. considers, in the prescribed manner, appeals of organizations and citizens on matters within its competence;
7.24. performs other functions as provided by the legislation.
8. Gosatomnadzor has the right to perform its tasks and functions:
8.1. to develop and submit to the leadership of the Ministry of Emergency Situations proposals on issues within its competence, including draft regulatory legal acts, draft technical regulatory legal acts;
8.2. to attract in the prescribed manner:
qualified specialists to participate in the examination and verification of the safety status of radiation facilities, nuclear facilities, nuclear power facilities;
on a contractual basis, scientific organizations, higher educational institutions and other organizations for the preparation of proposals on drafts integrated and targeted programs, the development of drafts regulatory legal acts, technical regulatory legal acts in the field of nuclear and radiation safety;
8.3. to carry out foreign economic activity in accordance with the legislation;
8.4. to request and receive in the prescribed manner information on matters within its competence from state bodies and other organizations;
8.5. to issue instructions for eliminating violations in the field of nuclear and radiation safety obligatory for implementation by organizations and individual entrepreneurs operating ionizing radiation sources, nuclear installations, nuclear power facilities;
8.6. to exercise other powers in accordance with its tasks and functions.
CHAPTER 4
ORGANIZATION OF THE ACTIVITY OF GOSATOMNADZOR
9. Gosatomnadzor is headed by a Head appointed to and dismissed by the President of the Republic of Belarus on the recommendation of the Minister of Emergency Situations.
The Head of Gosatomnadzor has deputies, including one first, who are appointed and dismissed by the Minister for Emergency Situations on the proposal of the Head of Gosatomnadzor and agreed with the Council of Ministers of the Republic of Belarus.
10. Head of Gosatomnadzor:
10.1. reports to the Minister of Emergency Situations;
10.2. manages the activities of Gosatomnadzor and is personally responsible for the implementation of the tasks and functions assigned to it;
10.3. issues orders and resolutions within its competence, approves regulations on structural divisions of Gosatomnadzor;
10.4. distributes duties between his deputies, determines the powers of Gosatomnadzor officials;
10.5. appoints and dismisses employees of Gosatomnadzor, with the exception of deputy heads of Gosatomnadzor;
10.6. represents the interests of Gosatomnadzor in state bodies and other organizations;
10.7. within the limits of the Ministry of Emergency Situations, manages the property of Gosatomnadzor, including cash, and acts without a power of attorney on behalf of Gosatomnadzor, opens accounts in banks;
10.8. applies incentives and imposes disciplinary actions against Gosatomnadzor employees;
10.9. takes measures to ensure compliance by the employees of Gosatomnadzor with performance and labor discipline, carries out measures to improve the conditions and protection of their work, rest and life;
10.10. ensures the implementation of decisions of the Ministry of Emergency Situations;
10.11. exercises other powers within its competence.
11. For collective discussion of the most important issues in Gosatomnadzor, a Board of 7 people is created, consisting of the head of Gosatomnadzor (chairman of the Board), his deputies and other senior officials of Gosatomnadzor.
The statute on the Board of Gosatomnadzor and its personnel are approved by the Minister of Emergency Situations on the proposal of the Head of Gosatomnadzor.
Decisions of the Board, aimed at regulating social relations in certain areas of activity and requiring regulatory consolidation, are documented in a protocol and submitted to the Ministry for Emergency Situations for the adoption of relevant resolutions and orders. Decisions of the Board on other issues are implemented by orders and instructions of the Head of Gosatomnadzor.
In case of disagreement between the Head of Gosatomnadzor and members of the Board, the decision is taken by the Head of Gosatomnadzor, reporting on it to the Minister for Emergency Situations. Members of the Board can inform the Minister for Emergency Situations of their position.
12. Under Gosatomnadzor, commissions, councils and other advisory bodies may be set up to consider matters within its competence.
